Receive a GM Energy Powershift Home Charger included with the purchase or lease of a Chevrolet Equinox EV, Chevrolet Silverado EV, GMC Sierra EV, or Cadillac LYRIQ.

This “Offer” is a private offer, only available to eligible customers who have received the communication, and that have purchased or leased a new Chevrolet Equinox EV, Chevrolet Silverado EV, GMC Sierra EV, or Cadillac LYRIQ from a participating GM dealer. This Offer is not available to the public. Subject to the definitions, qualifications, limitations and requirements set forth in these "Terms and Conditions", eligible customers may qualify to receive a GM Energy PowerShift Charger with the purchase or lease of an Eligible Vehicle. Customer must take delivery of eligible vehicle by 1/2/25 and redeem the GM Energy Powershift charger offer by 1/15/25.

Throughout these Terms and Conditions, You and Your or Customer refer to the purchaser or lessee of an Eligible Vehicle as identified on the dealership purchase order documentation, or otherwise by an eligible Participating Dealership. GM, We, Us, and Our refer to General Motors, LLC, a Delaware limited liability company. In addition, certain words and phrases are defined as follows:

a. Offer Term: This offer is available to eligible Customers who purchase or lease a new Chevrolet Equinox EV, Chevrolet Silverado EV, GMC Sierra EV, or Cadillac LYRIQ during the specified offer period, unless the Offer is terminated earlier at GM’s discretion.

b. Delivery Date means the date your Eligible Vehicle is reported as delivered by your Participating Dealer.

c. Eligible Vehicle means a new Chevrolet Equinox EV, Chevrolet Silverado EV, GMC Sierra EV, or Cadillac LYRIQ that an eligible Customer purchases or leases from a Participating Dealership located in the United States.

d. Participating Dealership, Participating Dealer or Dealer means a motor vehicle dealership located in the United States (not including Guam, Puerto Rico or other locations) that is authorized in writing and verified by GM to advertise and sell new GM electric vehicles.

Eligible Customers will have the opportunity to receive a GM Energy PowerShift Charger for no additional cost after the delivery of the Eligible Vehicle. This Offer is limited to one PowerShift Charger per Eligible Vehicle purchased or leased, and repeat eligibility does not apply. Eligible Customers will be contacted by a GM Energy - Home Energy Consultant via the email and/or phone number provided by the Customer at the time of delivery of Eligible Vehicle with their Dealer. A Home Energy Consultant must verify that the Customer’s identity matches the information on the Eligible Vehicle’s order. Only the Customer on the vehicle order is eligible for the Offer.

Once a Customer’s identity is verified, they will be contacted by a GM Energy Home Energy Consultant and asked to share their GM “MY ACCOUNT” or sign-in on the GM Energy website (gmenergy.gm.com/home). If the Customer does not have a GM “MY ACCOUNT” they will be required to create an account. Failure to access the GM Energy Website and have or create a GM “MY ACCOUNT” will cause such Customer to be ineligible for the Offer. Once the account is logged into/created and necessary information is validated, the Customer must authorize the Home Energy Consultant to add a GM Energy PowerShift Charger to their online shopping cart in order to add a promotion code. If the eligible Customer is checking out on their own, the GM Energy Home Energy Consultant will provide the Customer with a one-time use promotion code to apply to their cart after adding a GM Energy PowerShift Charger to their online shopping cart. The website will automatically apply the Offer and reduce the price of the GM Energy PowerShift Charger from $1,699.00 to $0.00 at the time of check out. Each Customer can purchase additional products and/or services from the GM Energy website, however, no additional purchases are necessary. No other products or services are included in this Offer and must be purchased separately.  Taxes may apply. Once the Customer is ready, the Customer must go through the checkout experience and provide all necessary information. Additional terms and conditions may apply to other items selected by the Customer.

Each Customer is solely responsible for installation and use of the GM Energy PowerShift Charger. Customer is solely responsible for all permitting, approvals, such as from an applicable homeowners’ association or landlord, and all associated costs for installation and use of GM Energy PowerShift Charger. Customers may have the option to receive third party installation recommendations from their Home Energy Consultant. GM and GM Energy are not responsible for the actions of any recommended installation services or providers. Each Customer is solely responsible for use of such third parties.

If the Customer receives the GM Energy PowerShift Charger and proceeds to cancel its order for an Eligible Vehicle before the Vehicle is delivered to the Customer, the Customer will be responsible for reimbursing GM the total value of the GM Energy Powershift Charger, direct to GM, upon GM’s request. GM will issue a written request for reimbursement, and the Customer is required to remit payment within 10 days of receiving this request. Failure to provide reimbursement within this period may result in additional collection actions as permitted by law, including the assessment of interest on overdue amounts.

The GM Energy PowerShift Charger is provided as part of this Offer without any warranty, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. GM disclaims any responsibility for issues arising from the use or performance of the charger beyond those expressly covered by GM’s standard warranty terms (if any)

a. Agreement to the Official Rules: By accepting and receiving the benefit of this Offer described herein, each Customer fully and unconditionally agrees to and accepts these Terms and Conditions as the official rules of the Offer and further agrees the decisions of GM regarding this Offer are final and binding in all matters related to the Offer. These Terms and Conditions, constitute an agreement (this "Agreement") between GM and the Customer, and is the entire agreement between the parties concerning its subject matter, supersedes all prior agreements and understandings, whether or not written, and is not intended to confer upon any person other than the parties, including any creditors, any rights, or remedies hereunder.

b. General Conditions / Release: Each Customer, by participating in this Offer, agrees (a) to release, indemnify and hold harmless GM, its affiliates, parents, subsidiaries, advertising and Offer agencies and their respective past and present directors, officers, employees, representatives and agents from and for any liability for any injuries, losses or damages of any kind, to persons or property (including without limitation death; claims based on publicity rights, defamation or invasion of privacy; and any claims based on a violation of a third party's intellectual property rights), resulting in whole or in part, directly or indirectly, from your participation in this Offer, installation, or in any related activity or your acceptance, possession, use, misuse or nonuse of a home charging outlet or unit. GM is not responsible in any way for installer actions, recommendations, or any resulting damage caused by or attributable to your installer. GM's failure to enforce any of these Terms and Conditions shall not constitute a waiver of that provision.

c. Limitation of Liability: To the fullest extent permitted by law, GM, its affiliates, and their respective directors, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the Offer, including but not limited to any installation, use, misuse, or inability to use the GM Energy PowerShift Charger, even if GM has been advised of the possibility of such damages. GM’s total liability in connection with this Offer, whether in contract, warranty, tort (including negligence), or otherwise, will not exceed the retail value of the GM Energy PowerShift Charger.

d. Disputes: In consideration for the benefits that you receive under this Offer, you agree that any dispute relating to any aspect of your relationship with GM or any of its affiliates, including the purchase, installation and performance of your home charging outlet or your vehicle, shall be fully and finally resolved by binding arbitration administered by the American Arbitration Association (the "AAA"). The rules governing the arbitration may be accessed at www.adr.org or by calling the AAA at +1-800-778-7879. To the extent the initial filing fee for the arbitration exceeds the initial filing fee for a lawsuit, we will pay the difference in fees. ANY ARBITRATION WILL BE CONDUCTED BY THE PARTIES IN THEIR INDIVIDUAL CAPACITIES ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION, AND THE PARTIES WAIVE THEIR RIGHT TO FILE A CLASS ACTION OR SEEK RELIEF ON A CLASS BASIS. THE PARTIES FURTHER EXPRESSLY WAIVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, Customer's rights and obligations, or the rights and obligations of GM in connection with the Offer, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

e. Termination of Offer: GM reserves the right to terminate or suspend this Offer at any time and for any reason without prior notice. If the Offer is terminated before a Customer’s receipt of the GM Energy PowerShift Charger, GM will have no further obligation to fulfill the Offer. In the event of any cancellation, termination, or suspension, notice thereof will be posted on this Terms and Conditions webpage. It is the responsibility of each Customer to check back on this page for important updates and changes to these Terms and Conditions.

f. Misrepresentations and Fraud: Your participation in the Offer may be cancelled by GM, in its sole discretion, if you conceal or misrepresent any material fact or circumstance, including but not limited to your personal information, Eligible Vehicle, or any information provided on the EV Install Form, or otherwise. GM has the right to cancel this Offer at any time for any reason if it suspects a Customer of fraud or misrepresentation in connection with this Offer.

g. Non-Transferable: An eligible Customer may not assign or transfer its rights under the Offer at any time. The rights under the Offer are non-transferable to any subsequent purchaser or lessee, or any other person or entity to whom the Eligible Vehicle is conveyed by operation of law or otherwise, including without limitation repossession, death, or as a gift.

h. Tax Implications: You may be subject to federal, state or local tax on any benefits received under this Offer. You should contact a Tax advisor/consultant if you have any questions regarding the tax implications associated with this Offer.

i. Force Majeure: GM will not be liable for any delay or failure to perform its obligations under this Offer if such delay or failure is due to any cause beyond GM’s reasonable control, including but not limited to acts of God, war, government action, terrorism, civil disturbance, labor shortages, or supply chain disruptions.

j. Severability: If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be severed from the remaining Terms and Conditions, which shall remain in full force and effect.

k. Amendment Rights: GM reserves the right to modify, amend, or supplement these Terms and Conditions at any time, in its sole discretion. Any modifications will be posted on these Terms and Conditions webpage, and it is the responsibility of each customer to review the Terms and Conditions periodically.
